UNMARRIED PARTNER VISA

The UK citizen or permanent resident must be their genuine partner and the couple must intend to continue living together.

This visa is for couples who do not intend to marry or who cannot marry and same-sex partners of British Citizens or permanent residents.

Since 1997 it has been possible for unmarried partners both in a heterosexual and same sex relationship to gain entry to the UK using an Unmarried Partners Visa.

Eligibility Criteria:

  • To qualify for an Entry Clearance or Further Leave to Remain application as an Unmarried Partner for a 2 year probationary period there are basic requirements that must be met. Both parties must be at least 18 years of age and have been living together for 2 years.
  • To obtain a family Visa it is necessary for you to fulfil the basic prerequisites set out by UK Immigration Authorities. Regardless of whether the application is made within the UK, abroad, or for an extension (where applicable), the requirements are similar.
  • In order to be eligible for the Unmarried Partner Visa the couple must have lived together for two years and provide documentary evidence confirming that you have been living together for this time. If you have been together for less than 4 years you are granted a visa for a probationary period of 2 years. Indefinite Leave to Remain (ILR) - permanent residency - may be applied for at the end of two years.
  • If however, the couples have been living together for four years or more outside of the UK and can provide documentary evidence to substantiate this claim, you may be granted ILR without having to live in the UK for two years.

Furthermore, you must demonstrate that you intend to live together permanently with your partner and that you possess sufficient funds to pay the couple’s living expenses and those of any dependants without claiming public funds. Overseas applicant’s must be at least 16 years old and the UK sponsor must be at least 18.

Children of the unmarried partners who are under 18 years old are allowed entry to the UK as dependants, and can make their application at the same time as the main applicant.

Your Visa is valid for two years. You have permission to work in the UK during this period. You can also enter and leave the UK during this period without any further permission.

You can obtain permanent residency upon successfully completing the two year probationary period, except for family members of EEA nationals who have to satisfy a five year period. You can apply for British Nationality after holding Indefinite Leave to Remain (ILR) for one year and residing legally in the UK for three years with your spouse or five years for EEA nationals and other relationships.
