INDEFINITE LEAVE TO REMAIN (ILR) VISA FOR UK RESIDENCY

Indefinite leave to remain (often known as ILR) is permission to stay permanently (settle) in the United Kingdom, free from immigration control. This is commonly called Full Residency or Permanent Residency. ILR entitles you to permanent residency in the UK as well as visa-free travel in and out of the UK.

In order to apply for permanent residence, you will normally first need to show that you have enough knowledge of language and life in the United Kingdom.

You can apply for ILR if you have been living in the UK for specified period of time (usually between two and five years), you can apply if you are a

  • work permit holder;
  • bereaved partner;
  • highly skilled migrant;
  • representative of an overseas newspaper, news agency or broadcasting organisation;
  • private servant in a diplomatic household;
  • overseas government employee;
  • minister of religion, missionary or member of a religious order;
  • airport-based operational staff of an overseas-owned airline;
  • person with United Kingdom ancestry;
  • writer, composer or artist;
  • person with long residence in the United Kingdom;
  • former member of HM Forces; or
  • person who is in the United Kingdom for other purposes or reasons not covered by other application forms (this does not include asylum).

The applicant must not have spent too much time outside the UK or committed any offences.

You should note that to keep your permanent residence you should not spend longer than two years outside the UK. If you continue to only spend short periods of time in the UK over many years it is likely that there will come a time when you will lose your indefinite leave to remain in the UK.

You should maintain ties to the UK and should consider the UK as your home (Permanent Residence).

Once you have held ILR for a period of one year you may be able to apply for British Nationality.
